I can't see how a scene can be copyright (unless it is substantially of something which is itself copyright) and I can't see how using "Canon Color Accent" can be copyright; so is the creative effort required to use the latter on the former really sufficient to create an instance of a copyrightable work?

I'm fascinated by this post: http://forums.dpreview.com/forums/readflat.asp?forum=1010&message=21374204 wherein Andy Pippins claims that he had the 'creative idea' himself back in the 70's. I wonder if he has any documentary evidence of that; if so, New England Teas might like to hear from him. Perhaps Andy Pippins might like to sue the "Temple Island Collection" and see how they feel about it!

I'm going to email Andy and see if he has any feelings on this matter - should be interesting!

Wouldn't the guy or team that created the Canon creative setting, who actually thought of it have the rights, if not someone before? :)

Well that was a surprise to be reminded of "Alternative Photographics" after all these years! I did indeed often talk about my ideas of a red London bus going over a bridge, and the bus being the only colour in the image. In fact I can still see the image in my mind's eye.  This bridge was more himp backed, and the bus looms over the brow. However, the facilities available to the amateur at the time (and an impecunious amateur too) just did not allow me to realise my masterpiece. The one fellow member of AP I was in touch with, and who could have corroborated my story, died 18 months ago of mesothelioma.

I have to say I am alarmed that this company can claim a copyright on the whole concept of a red bus in a B&W image. That is a complete travesty of justice.

Interestingly, having declared how great the Color Accent facility is, I then never used it again. If I want that effect I can achieve it whenever I want in Photoshop

I think it's great that Andy Pippins dropped by... isn't the Internet great? Andy, I understand that you see it as a travesty as a whole, but I'm curious to know if you feel any ownership of the concept, and if that has any impact on your view of the subject as a whole.

To be honest, part of my argument is that accenting a red bus is quite an obvious idea, so it seems silly to ask if you 'invented it', but do you feel that it was your original idea? Or did anything influence you? I realise it's a long time ago and you may not remember. Were you aware of any examples of this prior to 2005 when the Temple Island Collection photo was 'taken'?

P.S. I don't know if Americans know what a humpback bridge is, even... we don't have them in Canada either. And yet, in the photo I found, they're driving on the right, so maybe... ???
